NUMI is a business unit belonging to MODEMA SAC (hereinafter " NUMI "). Access to and use of this website is governed by the "Terms and Conditions" described below, as well as by the laws applicable in the Republic of Peru. Consequently, all visits and all contracts and transactions made on this site, as well as their legal effects, will be governed by these rules and subject to this law.

The Terms and Conditions contained in this instrument will apply and will be understood to form part of all acts and contracts that are executed or celebrated through the offer and marketing systems included in this website between the users of this site and NUMI , which will be referred to hereinafter also indistinctly as "the company", or "the offering company", "the supplier" or "the supplier company", as appropriate to the meaning of the text.

Acceptance of the Terms and Conditions of Sale described below is required for purchases made in the NUMI Online Store. Any person who makes a transaction in the NUMI Online Store, or through the telephone number designated by NUMI for this purpose, declares and acknowledges, by making the purchase, that they are aware of and accept each and every one of the Terms and Conditions described below. The Terms and Conditions shall be deemed to have been acknowledged and accepted by the sole act of registering and/or purchasing products through this site.

NUMI reserves the right to update and/or modify the Terms and Conditions detailed below at any time without prior notice. For this reason, we recommend reviewing the Terms and Conditions each time you use this Site.

Below we detail the Terms and Conditions:

1. USER OR CUSTOMER REGISTRATION.

To purchase products on the site, registration is not required. Each user's registration is verified by completing and subscribing to the form on the site and then submitting it automatically by clicking on the corresponding element.

 

2. RIGHTS OF THE USER OF THIS SITE.

The user will enjoy all the rights recognized by current consumer protection legislation in Peru, as well as those granted in these terms and conditions. The user will have the right to information, rectification, and erasure of personal data at all times in accordance with Law No. 29733 on the protection of personal data. Simply visiting this site, where certain goods and services are offered, does not impose any obligations on the consumer, unless they have unequivocally accepted the conditions offered by the provider, in the manner indicated in these terms and conditions.

 

3. PROCEDURE FOR USING THIS SITE.

In the contracts offered through this site, the offering company will clearly and easily inform you of the steps that must be followed to enter into them.

4. PAYMENT METHODS THAT CAN BE USED ON THIS SITE.

The products and services offered on this site, unless a different payment method is indicated for specific cases or offers for certain goods or services, may be paid for using the following payment methods permitted on this site:

1. a) Debit Cards* Visa, MasterCard or American Express.

1. b) Visa, MasterCard, and AMEX credit cards issued in Peru. The use of the aforementioned cards will be subject to the provisions of these Terms and Conditions and, in relation to their issuer, to the provisions of the respective Opening Contracts and Rules of Use. In the event of a conflict, the provisions of the latter will prevail.

Regarding bank cards accepted on this site, all aspects related to them, such as issue date, expiration date, limit, blocking, secret code, etc., will be governed by the respective Opening Agreement and Rules of Use, so NUMI will not be liable for any of the aforementioned aspects. The site may indicate certain purchase conditions depending on the payment method used by the user.

* Payment by debit card is governed by the terms and conditions established by the bank issuing the card.

 

 

5. FORMATION OF CONSENT IN CONTRACTS ENTERED INTO THROUGH THIS SITE.

Through this website, the company will make offers of goods and services, which may be accepted electronically or by telephone, using the mechanisms provided on the site itself. All acceptance of offers will be subject to the condition precedent that NUMI validates the transaction. Consequently, for any transaction carried out on this site, confirmation and/or validation or verification by NUMI will be an essential requirement for the formation of consent.

To validate the NUMI transaction you must verify the following:

1. a) Confirm the price of the item ordered. Despite our best efforts, it is possible that the price of some of the products offered in our Online Store may be incorrect. Therefore, if the correct price of the product listed in your purchase order is higher than the price indicated in our Online Store, we will contact you to inform you of this fact. You may indicate whether we proceed with your shipment using the correct sales price or cancel your order.

1. b) Validates and accepts the payment method offered by the user.

1. c) That the data registered by the customer on the site matches that provided when accepting the offer.

Once validation is complete, NUMI will contact the user by telephone or use any means of communication that guarantees the consumer's due and timely knowledge, which will be previously indicated on the same site, in order to inform them of the result of the same. Consent will be deemed to have been formed from the moment NUMI successfully completes the validation and informs the user. In accordance with the provisions set forth in the preceding paragraphs, and as a measure to protect the security of transactions, NUMI may void purchases in which the data provided by the customer does not match the databases available to NUMI , or in respect of which the aforementioned validation has not been carried out within 48 hours following the purchase order. That is, if it becomes necessary to contact an account holder and it is not possible within 48 hours of the purchase order being processed, NUMI will void the transaction (as a security measure for the customer) and notify the issuing bank of the credit card used when submitting the purchase request. The issuing bank of the credit card used to make the purchase request on the site must issue a refund in accordance with its policies.

 

 

6. DISPATCH OF PRODUCTS.

When products are stored in different sources, they will be dispatched independently, according to the options available on the site and chosen by the user.

 

 

7. VALIDITY, TERM AND STOCK OF THE OFFERS CONTAINED ON THIS SITE.

The prices of the products and services published on this site are valid only while they appear on it. NUMI may modify any information contained on this site, including information related to merchandise, services, prices, stocks, and conditions, at any time and without prior notice, until receiving a purchase request, which will be binding on NUMI subject to the validation conditions indicated in number 6, that is, once consent has been formed between the parties to a given transaction. The prices of the products and services published on this site will only be valid and applicable on this site and will not be applicable to other sales channels used by NUMI , such as physical stores, catalogs, or others.

The stock offered is one product per offer. The products and services published on this site are valid exclusively for family consumption; no more than one offer per person and/or credit card.

 

 

8. PAYMENT RECEIPTS.

According to the Payment Vouchers regulations approved by Superintendency Resolution No. 007-99 / SUNAT (RCP) and the Consolidated Text of the General Sales Tax and Selective Consumption Tax Law, approved by Supreme Decree No. 055-99-EF and amending regulations (TUO del IGV), it is concluded: "There is no current procedure that allows the exchange of sales receipts for invoices, furthermore, credit notes are not provided to modify the purchaser or user listed on the original payment voucher." Therefore, the customer must correctly decide which document to request as proof at the time of purchase, since according to the cited paragraphs, no change will be possible.

Electronic invoices, electronic sales receipts and electronic notes linked to these electronic vouchers will be made available through the BizLinks company website (https://sfe.bizlinks.com.pe/sfeperu/public/loginAnonimo.jsf), for which the necessary data will be sent to the email designated by the client so that they can consult the electronic voucher on the indicated website and have the possibility of downloading it, in accordance with Article 15 of Superintendency Resolution No. 097-2012 / SUNAT, Superintendency Resolution that creates the Electronic Issuance System developed from the taxpayer's systems.

 

 

9. DATA PRIVACY POLICY.

I accept the privacy and personal data protection policy of NUMI PERU SAC, identified with RUC 20603061439 as the owner of the NUMI personal data bank, in which all personal data provided in the Online Form will be collected. By accepting this privacy and personal data protection policy, you freely, previously, unequivocally and expressly authorize NUMI through the company name NUMI PERU SAC to process the personal data you provide through the store for such purposes: To send advertising through any means and support issued by NUMI or its business partners, to answer inquiries about products and services, to dispatch orders or to pay bills, sending invitations to activities convened by NUMI or its business partners, purchase history, history of habits and consumption preferences, and for statistical purposes and for the fulfillment of obligations in the event of a contractual obligation between NUMI and the customer. Likewise, personal data may not be transferred to NUMI 's domestic or foreign subsidiaries.
